Executive summary

EU implementation of Directive (EU) 2024/2853 is moving further into formal legislative machinery, but the pace is increasingly uneven.

The September position is:

  • 3 — National legislation adopted / measures notified
  • 7 — Parliamentary / draft stage
  • 11 — Legislative pipeline active
  • 6 — No public legislative step identified

Control: 3 + 7 + 11 + 6 = 27

The principal category change this month is Slovakia.

On 17 September 2026, the Slovak National Council approved the new Act implementing Directive (EU) 2024/2853. At the 24 September verification cut-off, promulgation in the Collection of Laws had not yet been identified.

That moves Slovakia from Legislative Pipeline Active to Parliamentary / Draft Stage under the methodology used for this monitor.

The headline numbers therefore move from August’s 3 | 6 | 12 | 6 to 3 | 7 | 11 | 6.

But the more important September story is not the arithmetic.

It is the growing separation between national implementation trajectories as the 9 December 2026 transposition deadline approaches.

Some Member States are already through national adoption or notification. Others are deep into parliamentary scrutiny. Several remain in government preparation. And six still have no qualifying public legislative milestone identified.

This creates a more complex readiness picture for businesses operating across multiple EU markets.


September movement at a glance

Slovakia — 17 September 2026

The Slovak National Council approved the Government bill on liability for damage caused by defective products.

This is a material threshold event. Parliamentary approval takes Slovakia beyond the pipeline stage.

At the verification cut-off, however, promulgation in the Collection of Laws had not yet been identified. The official National Council record remained in the post-third-reading editorial stage.

Italy — 15 September 2026

The Senate Justice Committee issued a favourable opinion with observations on Government Act 434, the draft legislative decree implementing Directive (EU) 2024/2853.

That is a significant step in the Italian scrutiny process, but the decree had not yet been treated in this monitor as finally adopted national legislation.

Monitor position: remains Parliamentary / Draft Stage.

Netherlands — 9–10 September 2026

The Tweede Kamer Justice and Security Committee decided on 9 September to register Bill 36 906 for plenary treatment.

The current official parliamentary programme lists the bill as expected in week 3 of 2027.

That falls after the Directive’s 9 December 2026 transposition deadline.

This does not establish that the Netherlands will transpose late. Parliamentary scheduling can move. It does, however, create a visible timetable-risk signal.

Finland — September 2026

Finland’s Government proposal to amend the Product Liability Act remains in preparation.

The official Government legislative programme moved the estimated presentation from week 37 to week 39 of 2026.

At the verification cut-off, the proposal had not yet been submitted to Parliament.

Monitor position: remains Legislative Pipeline Active.

Sweden — 10 September 2026

Sweden’s Lagrådet issued its opinion on the proposed new Product Liability Act on 10 September 2026.

The opinion addresses, among other matters, the Directive’s full-harmonisation character, causation drafting, the timing of manufacturer control and evidentiary provisions.

At the verification cut-off, the Government’s legislative chain still showed no proposition to the Riksdag.
